I'm considering initiating legal action against MTNL because they have refused to correct my bill (inclusion of NU usage in excess downloads and improper maintenance of usage logs thereby leading to erroneous calculations). If anybody wants to join the action, we can file collective complaint before TRAI. AFAIK, TRAI can only entertain matters from group of consumers while individual consumers have to approach the Consumer forum. So anybody in?

Agreed logs are maintained improperly and billing is lame but....Think again !!!!!Do you think u are clean ??????I mean u havent downloaded anything illegal or por* ?well u see they have logs of all ur daily surfing habits. Do u used to restart router before and after NU usage ?Do you have any sideby bandwidth counting software in windows to show the proof ?answer these questions and then decide.I think these are all valid pointsAfter all Consumer is always right ? B)Most of the cases YES

I mean u havent downloaded anything illegal or por* ?[/b]
1.That is besides the point and cannot be called into question in a dispute of deficiency of service.
2. Are they terminating my service for illegal usage of their service?

well u see they have  logs of all ur daily surfing habits [/b]
Incorrect logs you mean...its debatable I think. Entries like:
0700-0749 xyz MB
(next entry) 0747 - 0750 pqr MB
As also the rare (but present) repeat entries.

Do u used to restart router before and after NU usage ?[/b]
1.Which was never expressly told to me and does not form a par of terms and conditions of service.
2.Which was never even shown on MTNL Usage page until after this month. (A valid point here though is that I don't have a screenshot of the older page).
3.Which was on website in a pdf user manual one month after the packages were in operation, which I might or might not have accessed.
4.Which does not absolve the service provider from his duty of maintaining proper logs which was the basis of the NU service.
5. Which was followed by me to the best of my knowledge and ability by scheduling computer shutdown.

Do you have any sideby bandwidth counting software in windows to show the proof ? [/b]
Hardly a proof. I intend to build on their own logs.

answer these questions and then decide.
I think these are all valid points[/b]
But debatable. The thing I do agree with is, time constraints. Also, the moment I approach a consumer forum they will instruct me to deposit the bill as a pre-requisite to admission of the complaint. And thirdly, I just can't do without net for the time period that dispute will be pending.

After all Consumer is always right ? [/b]
well *shrug* to each his own opinion...

Well these guys do have proper records of which sites u visited and durind what time.I had once asked the technician to justify my mb's downloaded without me doing anything. Then he told me that ur comp was connected to htttp://update.microsoft.com/windowsupdate/he also told me that i had visited yahoo, google, imdb, bombaybeats.fm sites just beforeDont underestimate that

Of repeat entriesIf you were to download a total of around around say 500Mb between 4am to 9am without turning CPE on/off during the download it would be considered as one session only.that is If you downloaded 400Mb between 4am to 8am and 100Mb between 8am and 9am the usage detail will be shown as:1. 4am to 9am 500Mb downloaded, charged for 0Mb and2. 4am to 9am 500Mb downloaded, charged for 100MbYeah i agree this might seem confusing at first but youll get used to it.

I interpret it as follows :
4am to 8am 0Mb
8am to 9am 100Mb (Even though u might have stopped download at 7.45 am or so) and thats where the counting server falters !!!!!

BTW it is possible to download about 100 mb in an hour.
This also shows that u didnt restart ur router at 7.50am
Y getting adamant just restart ur router at 12.05 am and 7.50 am everyday, its not a tough job
Even i got used to it since then i havent lost a single MB as of yet at night

chill dude..even i got an bohemian bill for the month of june..I dint followed the restart router schedule..And i got my bill for 4000/- ..even i thought i would sue MTNL for this..but then i acted very cool..i went upto area manager..he gave me 2 e-mail add of Broadband Chief accounting officer..i e-mailed to them...and got a positive reply as:-sorry of the greviences...there is a server problem going on..and ur bill has been corrected which is updated in the website"..I took a print out of this email and went to exchange and showed it to accounting officer...he immediately acted..and gave me an duplicated bill with proper billing..I paid just 670/- bucks instead of 4000/- ..isn't that grt??!!!

u think that is a prob? i ve just received a damned bill of 11k 9000 in excess charges!. no breakup nothing just usage charges of 9077!

i guess this is going to be a long fight and i dont even know where to begin

I mean u havent downloaded anything illegal or por* ? [/b]

BTW is downloading porn illegal? I guess distribution is, viewing in private is not.

nocaps I don't want to discourage you but what I feel is ur case is going to be weak.. have u discussed it with any legal expert.

Moreover the cause of the problem seems that u didn't restarted router, u can try bridged mode setting ( which I guess these so called MTNL technitians don't know)
I guess this should be the standard installation... this way u get direct control over the net connection. Just a scheduled task in windows is all that takes to free u all of your worries.

@jayesh..i think u r in a hot mood..even i was the same when i got my huge bill

btw i want all of u guys to see my old bill of june

Hey !!!!!!! whtever the bill issue may be.....but I really don't think tht u can get a huge bill coz. u D/L porn. Also, If the matter goes into legal issues, this point will be funny, MTNL guys saying - The customer D/L porn, so we counted his Night MB's in the Day's slot.......RUBBISH !!!!!!!! 😛
