and i believe it is pretty much legit considering wireless internet does not come under network neutrality concepts in the US market now.

There are no real 3G plans here anyway. only BSNL & MTNL is providing unlimited 3G and they have already restricted the speed of many users depending upon the area as it can be seen in MDMA.
