Broadcast tribunal TDSAT has issued notices to direct-to-home operator Tata Sky over a petition alleging "illegal and unauthorised" removal of prime channels by the operator from its basic package has forced its subscribers to pay more.

The tribunal also issued notice to sectoral regulator Telecom Regulatory Authority of India (TRAI) after the West Bengal-based Federation of Consumer Associations submitted that it failed to discharge its duties by not enforcing the mandatory conditions of providing a-la-carte (pick and choose) on DTH operators.

TDSAT Chairman Justice Arun Kumar has directed TataSky and TRAI to file their replies within two weeks.
In its petition, the consumer organisation alleged that TataSky, in a 80:20 joint venture with broadcast major Star, 'fraudulently' announced to reduce Rs 40 in its basic package from June 1, 2008 onwards.

TataSky took off prime channels such as BBC World, Star Sports, ESPN, Star Cricket, Ten Sports, BBC Entertainment and BBC Celebrity from the basic package and placed them on add-on packages, wherein a higher subscription fee is charged, the petition said.

"The above mode has been adopted by TataSky knowing fully well that most customers would choose to subscribe to these channels and therefore the reduction is totally illusory, whereas the increase in subscription rate is a certainty,"West Bengal based Federation of Consumer Associations said in a petition filed by advocate Navin Chawla.

"TRAI, on its part has been coming out with regulations in the name of customer interest, however, it has taken no steps to ensure that the benefit of its regulations do actually inure to those for whom it is meant," the federation said in the petition.

Great news  ... TDSAT should punish Tata Sky heavily...

The words used are very strong and to the point. Hope something happens. Else other operators wud try to follow same idea.

some one should also file for iteroperability and allowing users to use their own stb Dont know why no one is doing this till date

did you? 😛

aah..at last some good news..but am sure..TS would come out with something else now..cheap TS..

I hope the same and hope consumers benefit and thanks to West Bengal-based Federation of Consumer Associations for highlighting it to the TDSAT.......

TS is so cheap itll do watever to get more money frm customers
but is guess TDSAT allowed TS to provide ESPN channels on A-LA-CATRE

providing on ala carte basis is best if they want to provide subcriber more options. But TS is telling reason is to provide more options to subcriber and pulling more money from customer. number of channels pulled out from package is not and to get same channels what we are paying now is not acceptable from consumer point. 🙂

Is there any dth operator in any part of the world, who provides only la carte channels and no packages. I am under the imprssion, that only expensive channels will be available for individual ordering.
