Tata photon says 3.1 mbps is narrowband to avoid TRAI BB legal defination

SO according to TATA photon their 3.1mbps unlimited is defined as narrowband as after you reach the fup limit your speeds are reduced to 155k.First how can 3 mbps be defined as narrowband?.This might be a loophole that isps are using to give minimum 512k speeds.So airtel can also reduce 4mbps plan to 155k and say it is a narrowband.The fact that you are advertising upto 3.1 means it is broadband.Can someone find the term broadband or narrowband in their site?
 
The service is very pathetic. During and after the usage of the data limit the speed is very slow. I have done a big mistake by taking this connection and even bought that Rs. 1800 dongle which is of no use if I choose to switch ISP provider. Now I am thinking a BSNL broadband connection is the best one to take for as I used it for 3 years in bangalore without any issue at nearly the same rate as this one.PS: As I have mentioned another ISP name don't think that I am working for them. I am a IT Security consultant.
