SC issues notice to ESPN, TRAI on Tata Sky plea:thumbsup:
May 16,2009
New Delhi, May 15 The Supreme Court today issued notice to TRAI and ESPN Software Ltd on a petition filed by Tata Sky challenging the telecom tribunal TDSAT&aposs ruling that allowed broadcasters and DTH operators to negotiate rates for the channels provided on DTH platform as add-on packages.
The apex court also asked sports broadcaster ESPN to offer its channels to Tata Sky - a direct-to-home (DTH) operator - at 50 per cent of non-CAS area tariff.
A bench headed by Chief Justice K G Balakrishnan, while issuing notice to ESPN and Telecom Regulatory Authority of India (TRAI), directed the former to follow the 50 per cent norm till the telecom regulator came out with a consultation paper that covered tariff regulation for the DTH sector.
The bench asked ESPN to continue with the interim arrangement put in place by the sectoral tribunal Telecom Disputes Settlement and Appellate Tribunal in May 2007 in another petition.
As per the TDSAT norm, the broadcasters should offer their content to DTH operators at 50 per cent of the rate charged by them from the cable platform till TRAI comes out with the price fixation regulations for DTH.
