SBI rejected ATM glitch complaint stating the user was not the account holder himself

SBI says husband can't use wife's debit card, court agrees | Bengaluru News - Times of India

Marathahalli resident gave her debit card with PIN to her husband to withdraw Rs 25000 from a local SBI ATM.
Her husband went to the ATM and swiped the card, the machine delivered a slip showing money was debited, but the amount was never released.
SBI cites 'non-transferable' rule, says account holder was not ATM user, turns down money claims.

Banking rules categorically state that an ATM card is non-transferable and no other person apart from the account holder should use it.

there is enough evidence to support that the money was never released by the atm. but just because the atm user was not the account holder, the claim was rejected. this is kind of insane.
 
well in this particular case... the lady could not have filed a police complaint. fraud is a completely different issue.
here the consumer got scammed by the bank on the basis of a technicality.
 
This case is the definition of scam, using technicality as an excuse. According to ATM cash verification report there was excess 25000 rupees which was also confirmed by cctv so it doesn't make sense why SBI would not issue refund.

In case of fraud with FIR do Indian banks easily refund money ? or just make some technical excuse ?
 
heh. that's why i said. consumer got scammed by the bank here. and sadly, the courts sided with the bank. they could have at least asked them to refund the money and issued a warning to the account holder.
