GST on Smartphone Purchase

Hello,

How much is GST rate for a smartphone purchase? There is a billing dispute with a local seller who is adding 18%. I suppose it should be 12%.

Can someone please confirm? Or PM me a copy of any smartphone purchase with GST from Amazon/Flipkart etc.? It can be used to give as a credible proof.
 
i haven't purchased a smartphone for myself since gst was introduced so cannot post an invoice. have pinged two friends who recently bought phones.

There are two conflicting entries:

1) 12% on Telephones for cellular networks or for other wireless networks

2) 18% on Telephone sets; other apparatus for the transmission or reception of voice, images or other data, including apparatus for communication in a wired or wireless network (such as a local or wide area network), other than transmission or reception apparatus of heading 8443, 8525, 8527 or 8528

Now since smartphones fall under 2nd item (capable of voice, data, wireless nework) - it would be 18%

I doubt that many actually go through GST rates in detail.

Its easy to just read first entry in GST rates which states 12% for telephones for cellular networks.

And not notice 2nd entry

PS: Personally I would prefer 12% as it will save me 6% .. But I am just pointing out legal rates.
 
@Sushubh Could you please privately send me a copy of the bill in which Amazon logo, seller info can be seen? If I show kind of copy to seller, it would solve everything.
 
I think telephone sets is the old school landlines used in offices and stuff. telephone means mobile phone

But old school landlines never had data or LAN/WAN facility. And they have specifically mentioned it.

they didnt say telephone sets having data. they said telephone sets and other apparatus for the transmission /reception of data like rotuers/telephone towers etc
