Yep I told you so! Asking someone to give away constitutional right is definitely illegal.

You can expect but you can not bind them in an agreement or contract.
 
Asking someone is not illegal.
Getting an affidavit is not illegal.
The affadavit is a piece of paper.
It's not legally enforceable.
So he is not doing anything illegal.

So asking someone to murder someone should not be illegal too?

In my opinion, asking someone to sign something which prohibits fundamental / constitutional right is illegal.

Waiving right voluntarily is legal. But saying you must waive it - is illegal.
 



It's more like agreeing to terms of use on websites. Most of the them would be legally unenforceable. But it doesn't become illegal for anyone to put it on their website. Like you lose your right to sue us by agreeing to this clause or whatever.
