Right to Recall and Right to Reject!

Its futile. In parliamentary system right to recall leads to destabilization and in India each mp represents 2.1 million indians.to even have 10% of signatures to have a recall will mean 20lakh people signing and in India most of them cant even write.

Secondly the executive and the legislature is fused,so in a assembly or parliament has eg 51 INC and 49 NDA mps and the 51st INC mp is recalled and a NDA mp wins,it will lead to dead lock or if 2 NDA mps win then without elections the govt will change by only 4.2 million voters. This is not democratic.

Thirdly neither manmohan singh, nitish kumar, mamta banerjee can be recalled as they are from upper house and mamta banerjee is not even a mla!!.The constitution allows you to be CM\PM for 6 months without being a mla or mp!!!.

look at my topics.
The solutions are term limits, frequent elections, primary elections and increasing lok sabha seats to 1543 mps.
Even with 1543 mps each mp will represent 777,000 people whereas in USA each house of representative represents 740,000 people.
India is the most undemocratic democracy

----------

Even recall elections in USA are not successful. The Wisconsin collective bargain protests where the electorate recalled 8 republican state senators, only 2 were successfully recalled. It is a waste of money.

you are confused with right to reject.
here is ECI clarification
A hoax has been circulating which claims that if the '49-O' votes more than those of the winning candidate, then that poll will be canceled and will have to be re-polled. Furthermore, it claims that the contestants will be banned and they cannot contest the re-polling for their lifetime. This is false and has no basis whatsoever

Exercising "Right to recall" is not easy because it needs a process by common men.But exercising "Right to reject" is easy because most process is done govt/election body, we just have to give "reject" vote. But both shud be implemented.

"It is clarified that under Rule 49-O, the voter has an
potion not to vote at the election after he has been identified at the
polling station and his name has been registered in Registers of voters
(Form -17A). The Presiding Officer shall thereupon make a note to that
effect against the name of that voter and obtain his signature (thumb
impression in the case of an illiterate ). In such case, the voters who
exercise the option of not voting at the election under Rule 49-O would
only be deemed to have abstained themselves from voting and under the
law, the candidate who secures highest number of valid votes polled,
irrespective of his winning margin, is declared elected."

So you are identifying yourself and giving your fingerprint. The only outcome is that you have abstained.

Even anna hazare is misinformed.

here is the private members resolution by Shri Prabhat Jha on 4 march 2010 in rajya sabha

Bulletin-II

----------

excerpt
" if 10 per cent of the electorate in the constituency of an elected Member of any legislature file a petition duly signed by them with the Election Commission mentioning that the Member is incompetent and unable to discharge his/her duties, the Election Commission may cancel the election of that Member of the legislature and hold re-election or declare elected the candidate who obtained the second highest votes in the election; and

[*]if three-fourth of the elected representatives of a local body lodge a complaint, in writing, with the District Collector to recall any Member and in case, the complaint is confirmed, the State Election Commission may cancel the election of that elected Member and declare elected the candidate who obtained the second position in the election or make arrangement for re-election there.”"
[/list]3\4 of a constituency is is 1.5 million so forget it.If pop of india was 50 million then it would have been possible.
10% is 20 lakh and i bet in villages many dont know how to sign.
This is utopian concept.Rather than we should have term limits, primary elections where we choose who will fight the general election, frequent election and enlargement of seats.
In gurgaon only 1 mp represents the entire city.
