The Telegraph - Calcutta (Kolkata) | Nation | Privacy muscle to protect identity

they have copied the Canadian model!

"
If enacted, the privacy act will clear the way for setting up the PPA, an authority similar to the central information commissioner’s office.
The PPA, sources said, will be authorized to instruct various private and government bodies to share information with a complainant who feels his personal details have been compromised."

"Similarly, the PPA can instruct a telephone service provider to share information with a complainant who feels his phone is being tapped."

all it needs to be a hat trick is to have a clause that the govt or any private org cannot deny any benefit or service if you refuse to have any uid card.

india ranks in extensive surveillance but its if from 2007.THe it act 2008 makes it endemic surveillance.

How will the government dole out welfare benefits without UID?

much needed, supreme court has various times said that it is already a right covered under right to life, if it makes it officially into the constitution you could see tons of writs being filled, in that case Ratan tata had stated that is 'right to privacy ' was breached by the leak and the court upheld that writ.

the funny thing is that the UID project itself is a big sham on individual's privacy.

on paper yes. but the government seems to have solid plans in place that would make your life hell if you do not get it. think about a situation where getting a bank account or a mobile connection would require a UID number? what would you do? how would you escape the claws then?

Sushubh, its not mind games, its just playing games! Trying to fool people by diverting the attention away from real issues at hand like inflation, corruption, poverty.

"We are working on making right to privacy a fundamental right. It is likely to be tabled in the monsoon session of Parliament. However, it's difficult to commit the timeframe," law minister Veerappa Moily said.

We all know that legislation in India takes ages. On second thoughts, i am thinking the neta log are perhaps thinking of their own welfare rather than the welfare of the country. How, its pretty simple. By having a Fundamental Right to privacy, the neta log would be once and for all saved from investigative journalism from likes of Tehelka etc. No more sting reports.

Just my two cents!

catch 22 , lol , the way data privacy laws are in india it is really not funny , you know some DSA guy working for a cell company or a bank you can get fulll info on any one you feel like. it is that bad !! there is no law currently to protect customer privacy , i had got into a major fight with one leading cell service provider some 7 or 6 yrs back when my call list was pulled my ex gf 😕 [ she knew some girl working in cc there ] she made my life a nightmare in those days, cell provider denied giving it , until my lawyers sent very threatening notices , then i was given the option to put a password that ONLY i knew, the only way customer care could get my data or any DSA would be if i punched the pass on my cell otherwise only persons very high up could get it without pass, i think this service should be made for all customers this was a one of case and just due to the lawyers .data privacy laws are well quite f** here, am just glad they are atleast thinking of some accountability , let it come into place then hopefully we would see some PIL's being filed.

Here it is the bill which might increase our privacy.
experts plz comment
Draft Bill Right to Privacy

----------

I hope in the final draft wiretapping can only be allowed after warrant has been issued by a judge.

0_0 the document is secret!.admin i hope i am doing nothing wrong.Should this be moved to sensitive talks?

India’s new privacy law will not shield citizens from the intrusive eyes of security agencies but private entities including detectives could be sent to jail for intruding into your privacy.
The government has accepted the home ministry’s view that the new privacy law should not stand in the way of security agencies such as the Intelligence Bureau collecting information.
A government source told HT that the department of personnel & training (DoPT) — which is drafting the privacy law — was going by the home ministry’s view of “lawful interception regime, as it exists, should be taken as a permissible exception to the privacy law”.

Centre Giving Final Touches to Right to Privacy Bill - The New Indian Express

“The Ministry of Personnel is mulling to review certain clauses, which put Intelligence agencies under the scrutiny of competent court. The ministry is also examining whether the ‘Right to Privacy’ legislation should be applicable to Indian citizens only and not all residents of the country,” sources said.

Though, the draft Bill, 2014, has maintained the enhanced penalty clause of `2 crore against a person or agency involved in illegally intercepting communication, it will exempt the intelligence and law enforcement agencies from its purview, but with certain riders. `50 lakh penalty has been envisaged in the Bill if any government official or employee of a telecom service provider is found guilty of disclosing the prohibited personal data. A penalty of `50 lakh will be imposed in case data is obtained on false pretext.

The penalty for stealing personal data has been enhanced to `10 lakh for the first attempt and `20 lakh in case of a repeat offence.
